Terms of Service

By creating an account or otherwise accessing or using Elaicar (the "Service"), you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy. If you do not agree, do not use the Service. If you accept these Terms on behalf of a business, you represent that you have authority to bind that business.

Elaicar is a software-as-a-service platform operated by Elaitech for car rental businesses. It provides reservation management, fleet tracking, billing, public booking websites, an AI-powered WhatsApp Assistant, and related features. Features and add-ons may evolve over time.

• You must provide accurate, current, and complete information when registering. • You are responsible for keeping your password and account credentials secure. • You are responsible for all activity that occurs under your account. • Each dealer is responsible for the data they upload, including the lawful basis for collecting and storing data about their own clients and vehicles. • You must notify us promptly of any unauthorized use of your account.

You may not use Elaicar to: • Violate any applicable law or regulation, including Moroccan Law 09-08 and the GDPR. • Send spam, phishing, or unsolicited bulk messages via the WhatsApp integration. • Reverse-engineer, scrape, decompile, or attempt to copy the platform. • Upload illegal content, malware, or content that infringes third-party rights. • Interfere with or disrupt the Service or the servers / networks connected to it. • Use the Service to harm minors or vulnerable persons.

• Subscriptions renew automatically until cancelled. • All prices are listed in Moroccan Dirham (MAD) unless otherwise stated. • Taxes are added where applicable. • Refunds are governed by our refund policy and applicable Moroccan law.

New accounts may receive a 14-day free trial of the platform. No credit card is required to start. At the end of the trial, accounts must subscribe to a paid plan to continue using paid features.

You retain ownership of the data you upload to Elaicar (your customers' details, your fleet data, etc.). You grant Elaitech a limited, worldwide license to host, process, and display that data solely for the purpose of providing the Service to you. We do not sell your customer data. We process it as described in our Privacy Policy.

• You may cancel your account at any time from your dashboard. • We may suspend or terminate accounts that violate these Terms, with reasonable notice where feasible. • Upon termination, you have 30 days to export your data; after that, data is deleted as described in our Privacy Policy.

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, except as required by Moroccan law. We do not guarantee that the Service will be uninterrupted, error-free, or fit for a particular purpose.

To the maximum extent permitted by applicable law, Elaitech's total cumulative liability arising out of or related to these Terms or the Service shall not exceed the amount you actually paid to us in the 12 months preceding the event giving rise to the claim. Elaitech shall not be liable for indirect, incidental, consequential, or punitive damages.

We may modify these Terms from time to time. Material changes will be announced at least 30 days in advance via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.

These Terms are governed by the laws of the Kingdom of Morocco. Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Casablanca, Morocco, unless mandatory consumer-protection law requires otherwise.
